Apex court has issued an interim order no to exercise the ordinance on the citizenship law in the name of the Government. After the proper conduct of the primary hearing on the writ petition that has been filed against the decision of the government to implement the ordinance on the citizenship, supreme court has issued the order. The order was passed by the bench of 5 member which was headed by the Cholendra Sumsher- Chief Justice. The order has asked the government to make the proper arrangement for the distribution of the citizenship to the eligible Nepalese people as per the prevalent citizenship act duly endorsed by the Government of Nepal.
6 Writ petition were filed against the decision of the Government at the supreme court. The petition has challenged the decision made by the President Bidhyadevi Bhandari on 23rd of May at the recommendation of the council of Ministers. 5 members constitution bench were comprised of Justice Deepak Kumari Karki, Mira Khadka, Hari Krishna Karki and Ishwar Prasad Khatiwada.
Petitioners demanded to cancel the ordinance passed by the president as the ordinance was passed against the constitution of Nepal. Government, on the other side has defended that the ordinance has the legal base to correspond the provisions that has been mentioned in the constitution of Nepal.
